This chapter details the development and functions of Prime Minister Ehud Barak’s national commission of inquiry. This commission, chaired by Supreme Court Justice Theodor Or, was created to investigate the causes of the riots of Israeli Arabs during the second Palestinian Intifada and the way the police responded to these riots. The Or Commission submitted its report to the government in August 2003, and criticized Barak for taking insufficient action to prevent the use of deadly force by the police or to limit it. The commission recommended that Shlomo Ben-Ami, the minister of internal security at the time of the riots, should not be allowed to serve in this post in the future. It also made rulings regarding figures in the police force, and recommended that the Police Investigations Department investigate several incidents with the purpose of preparing criminal charges against some of the policemen involved in the deaths. The commission also examined the actions of several leaders of the Arab public, but refrained from making personal recommendations in their regard. Beyond this, it made general recommendations regarding the state’s, and in particular the police force’s, treatment of the Arab population.
