Interference in Knesset Procedures

Interference in Knesset Procedures

(p.167) 19 Interference in Knesset Procedures
The Purse and the Sword

Daniel Friedmann

Oxford University Press

This chapter describes several instances of court interference in Knesset procedures, and the implications thereof. The Supreme Court began to interject itself into the Knesset’s proceedings at the end of the classic Supreme Court period. It continued to intervene in Knesset decisions regarding the privileges and immunities of its members, even to the point where a reasonable decision made by the Knesset could be overruled by an unreasonable decision of the Supreme Court. The Supreme Court’s deep involvement in political issues and in petitions against the Knesset also brought about another significant development. Members of the Knesset would increasingly petition the court on manifestly political matters, sometimes against the Knesset itself or against its speaker.
