The most important constitutional development of the Emergency, other than its very imposition, was the enactment of the Forty-second Amendment. Coming in November 1976, the amendment demonstrated the progression of the Prime Minister and her government from having near-absolute power without a coherent programme — other than the protection of her prime ministry — to power expressed through fundamental constitutional change. The first concrete movement toward what was called constitutional reform came at the end of the 1975. This chapter describes these early stages of the progression toward the Forty-second Amendment, focusing on the formation, deliberation, and report of the Swaran Singh Committee.
