This chapter discusses the legal regulation of economic dismissals and presents an argument that states that the policy of minimizing social cost should comprise one of the principal guides to legal regulation of economic dismissals. As such, the approach presented in this chapter leads to a series of criticisms of the current British law, especially the award of severance payments under the redundancy payments legislation in the Employment Protection Consolidation Act 1978, Part VI.
