The One-Day Rule

The One-Day Rule

(p.108) 9 The One-Day Rule
A New Outline of the Roman Civil Trial

Ernest Metzger

Oxford University Press

This chapter offers two types of evidence for the existence of the one-day rule. The direct evidence is the provision of the Twelve Tables that appears to recite the words of the rule itself. Other evidence supports the existence of the rule by inference. The latter evidence includes passages from certain authors, commenting on the pressures of time in arguing before a court. First, the chapter discusses the direct evidence, arguing that the words of the supposed rule recite a different rule altogether. Then, the discussion attempts to explain the supporting evidence without resort to the rule. It also tackles the principle of immediacy, the one-day limit, the immediacy of judgement, and the repetition requirement.

Keywords:   Twelve Tables, principle of immediacy, immediacy of judgement, repetition requirement, direct evidence, one-day limit
