Chapter 1 sets the scene for this book by addressing a series of important issues underlying cultural heritage policy and law. It provides a brief historical review of cultural heritage protection from ancient to modern times and the development of legal frameworks for this, and considers the values that are implicit in cultural heritage. It deals with questions of terminology (heritage or property, tangible and intangible, safeguarding and protection) and with the apparent tension between characterizations of heritage as universal, national, and local, including the special position of indigenous heritage. This discussion also takes into account the new requirements and challenges posed by globalization with regard to heritage and potential responses to these.
