This chapter describes the different normative foundations that EU legal discourse has identified as underpinning the fundamental freedoms. These foundations are ‘internal’ to the law, and the subject of discussion in the legal literature. The goal is to set the stage for the subsequent analysis of how institutional constraints influence normative concerns and debates in legal practice. As such, this chapter will seek to merely identify and describe the various normative approaches that can be found in the legal literature.
