This chapter examines the latest efforts from the European Union and national policy makers requiring disputants to attempt mediation and other Alternative Dispute Resolution (ADR) options before going to court. It will argue that the use of mediation and ADR is still way below its full potential, despite numerous pro-mediation regulation being proposed and introduced at both the EU and national level. Accordingly, it will discuss current legislative trends and recommend best practices that the EU and the Member States should implement if they seek to leave national courts as the last resort option for resolving civil and commercial disputes.
