Chapters 2 and 3 established that assessing the problem of insolvency within MEGs should be done in light of insolvency goals. This chapter attempts to identify shared key objectives and tasks of insolvency systems which are also desirable on the policy level. Based on existing theories of insolvency law, the chapter considers what could be perceived as key values of insolvency systems and their corresponding tasks. It then shows that such objectives are also widely accepted among different legal regimes, primarily referring to key insolvency objectives as stressed in the UNCITRAL Legislative Guide on Insolvency Law.
