New Developments in the Notion of ‘Potential Victim’: The Preventive Dimension of Protection
The notion of victim originated in the legislative phase of human rights treaties and instruments, and gradually gained precision in the phase of implementation of those treaties and instruments. Soon it was clarified that it comprised both direct and indirect victims (the close relatives of the former). Furthermore, the notion of ‘potential victims’ became the object of a jurisprudential construction. Once accepted in international case-law, the notion of ‘potential victims’ has undergone new developments in recent years, which have a direct bearing on the issue of access to international justice and the legitimatio ad causam.
