Vexatious and Vexing Litigation

Vexatious and Vexing Litigation

(p.287) 8 Vexatious and Vexing Litigation
Petitions, Litigation, and Social Control in Roman Egypt

Benjamin Kelly

Oxford University Press

This chapter examines the use of the legal process for vexatious purposes, and the cases in which petitioning and litigation served to escalate rather than ameliorate existing disputes. It begins by examining the discourse of ‘vexatious litigation’ in the papyrological evidence. It then looks at the question of delation, arguing that this is only rarely evidenced, and connected mostly with cases which had a fiscal element and/or were relevant to the interests of the idios logos. Finally, the chapter argues that some parties appear to have used the law not to bring disputes to an end and restore relationships, but to pursue hatred, vengeance, and even feud.
