Judge and Jurist

Lord Hope of Craighead

Every judge is provided with a notebook for each case on which he or she sits so that notes can be taken of the evidence or, if he is sitting in an appellate court, of the argument. This chapter describes Alan Rodger's notebooks. These notebooks can be divided into three groups. The first consists of five cases in which Alan sat as a member of the Judicial Committee of the Privy Council (JCPC). The second consists of those in which he sat as a Justice of the UK Supreme Court in which he took very few notes. The third consists of the remaining seven cases in the Supreme Court in which his notes extended to three pages or more. The collection as a whole provides a fascinating insight into the range of issues that came before him, in the ordinary course of his business as a member of these tribunals, during the last six months of his career.
