The EU represents the most formidable case of ‘constitutionalism beyond the nation-state’ and the Council of Europe has also manifested a move towards constitutionalism in so far as the European Court of Human Rights has evolved towards becoming a human-rights constitutional court for Europe. The purpose of this book is to show that the constitutionalization of these two European legal and political structures has been strictly related to the enlargement of both structures, made possible by the fall of Communism in Central and Eastern Europe. This Introduction also notes a further dimension of ‘constitutional synergies’ in Europe, between the EU and the ECHR system.
