Article 39(1) CFR constitutes a restatement of the right of participation—as a voter or candidate—in elections to the EP as provided for in Articles 20(2)(d) and 22(2) TFEU. The second paragraph of Article 39 CFR corresponds to Article 14(3) TEU. The CFR Explanations underline that Article 39(2) CFR takes over the basic principles of the electoral system in a democratic state.
